New Hampshire Adopts Opportunity to Repair Law
New Hampshire Governor John Lynch recently signed into law notice and opportunity to repair legislation that provides home owners and home builders the option of settling construction defect disputes without having to engage in costly and time-consuming litigation.
With the June 21 signing of House Bill 469, New Hampshire becomes the first New England state to adopt notice and opportunity to repair law. Over the last three years, 23 states have enacted right to repair laws, and more than half the states now have them on the books.
“More and more states are recognizing that right-to-repair laws help to reduce the number of construction defect disputes,” said NAHB President Dave Wilson. “NOR laws are a win-win proposition, enabling builders and consumers to solve problems without costly litigation.”
The New Hampshire law requires home owners to provide written notice to builders 60 days before filing a lawsuit alleging that there is a construction defect in a newly constructed or renovated home. The builder would then have 30 days to offer to settle the claim by monetary payment, the making of repairs or a combination of both; propose to inspect the residence that is the subject of the claim; or reject the claim.
