Awards Recognize Advocates of Construction Defect Reform Laws
Eighteen state and local home builders associations received the Legislative Pathfinder Award for working in their respective state capitols to improve the industry's general liability insurance climate. NAHB President Kent Conine presented the awards during the State & Local Government Affairs Conference held recently in Wichita.
Associations from around the country were recognized for advocating construction defect dispute reform, most notably through “Notice and Opportunity to Repair” legislation. The laws establish a process for resolving disagreements over construction defects in the home rather than in court.
While the laws are not a cure-all for the liability insurance crisis, Conine said the legislation is a “very important part of a very complex solution.”
Thirteen states adopted some form of “Notice and Opportunity to Repair” legislation during the 2003 session, and a total of 18 states have these laws on the books.
