NAHB Conference Helps Alaska Builders Pass Construction Defect Bill

Seeking some help in encouraging its state legislature to enact an all-important “notice and opportunity to repair bill,” the Alaska State Home Builders Association found what it was looking for at the NAHB State and Local Government Affairs Conference, which was held last November in San Diego.

Vicki Portwood, executive officer of the association, said that the conference provided Alaskan builders with the tools they needed to help get a bill passed in one legislative session.

By networking with other attendees and participating in conference breakout sessions, Portwood, accompanied by other association members from Alaska, was able to make critical contacts with NAHB members from Arizona and Texas, two states with construction defect laws already on the books.

“Colleagues were so willing to help,” she said, “and that saved our association a lot of time and money.”

For builders in Alaska, this year’s legislative session was a success, highlighted by passage of a construction defect bill, H.B. 151, which was signed on July 10 by Governor Frank Murkowski.

The legislation establishes a formal process for a home owner to notify a builder of construction defects before initiating a lawsuit. It is part of an overall strategy to help builders work with insurers to lower premiums and risk, while helping to protect consumers.

The State and Local Government Affairs Conference is an intense, three-day event designed to share the latest in building industry legislative, regulatory, legal and political news and strategies.

Geared to state and local lobbyists, executive officers and politically active members, it is the only NAHB event that focuses solely on state and local issues.
